This case arose from the tragic death of a 6 year old child at a former quarry that had been converted into a swimming park.  This was the second drowning there within several weeks, prompting an investigation by the Virginia State Police.  The park eventually closed.  A well-known aquatic safety expert also testified of numerous design problems of the park, as well as negligent lifeguarding operations.  Just prior to the jury trial date, the case settled in mediation.
