This was a well-known, tragic accident which occurred on Logmill Road in Haymarket. An 18 year old driver was driving recklessly, lost control, and struck a tree. With him were four teenage passengers. Two died, and two were seriously injured. Our client had a severe leg fracture and other orthopedic injuries. The primary challenge to the case was identifying insurance coverage. The driver was completely uninsured, which is all too common. Therefore, we proceeded on an uninsured motorist (UM) basis and were able to identify two separate auto insurance policies within our client's household. One of the companies unsuccessfully tried to to deny coverage before paying, and we were able to make the best recovery possible under the circumstances. This settlement was eventually approved by the Prince William County Circuit Court. It also shows the importance of carrying as much uninsured motorist (UM) coverage as possibly on your own policy.
