If you were in a motorcycle accident where a car turned left in front of your bike, it’s often (but not always) the fault of the other driver. Motorcycles are smaller and often harder to see, which is why it’s much easier for a driver to miss one as they turn left.  However, the opposing driver may have available defenses set forth below.

While at the accident scene, it’s not a good idea to start pointing blame at others, even if you’re confident that they were at fault for the accident. Let the police and emergency response teams handle gathering the details, but make sure you get copies of the police report and contact information from the other driver and any eyewitnesses.

Please note that if you were speeding, ran a red light, were intoxicated, or were otherwise driving recklessly, the other driver will likely not be liable.  This defense is known as contributory negligence.

The police report and witness statements will be invaluable in your accident claim. Know that an attorney has the ability to help you obtain these records and use them as you file your accident claim with the insurance company.
